Club Membership Agreement- Discount Club

Introduction

Welcome to the OC Mommies Discount Club “Club” operated by Little Baby Bee, LLC (LBB). The Club was established to give members of www.ocmommies.com “the site” a forum to share and exchange discounts offered at local stores in Orange County and online. Upon joining the Club, members will be issued a membership card "card" which can be used at our participating business locations to redeem select discounts stated on the site.

By becoming a member of the Club and by using your Membership Card you are agreeing to the following specific terms and conditions of the Club Membership Agreement "Agreement". You acknowledge that the Agreement may be modified or terminated at any time without notice.  It is your responsibility to read this agreement in its entirely prior to enrolling in the club. You will be deemed to have accepted any change to this agreement if you continue to access information at the site and/or use your card.

1. Eligibility

Club membership is granted to parents in Orange County, California. Members must be at least 18 years of age. Interested parties may enroll in the club at the site. If you do not wish to join the site but would still like to take advantage of the club benefits, you may send an email to orangecountymommies@gmail.com

2. Membership Fees

Prior to joining the club, you will be required to pay a semi-annual membership fee. The cost of the club fee will be posted at the site and will be subject to change at any time.

Upon the receipt of membership fee payment in full, you will be granted access into the club and will be mailed a card. It is your responsibility to ensure that your correct mailing address has been received by LBB. Your card will be mailed within 5 days of receipt of full payment and mailing address.

3. Membership Card Use

Your card is only good at participating stores listed at the site.   Discount offers are subject to change at any time without notice.  Your card must be present at the time of purchase and is limit one card per person per day. The card has no cash value and is non-transferable.  The card is not valid with any other offers or discounts and is not valid for gift certificate purchases or online purchases unless otherwise stated at www.ocmommies.com. The card is only valid until the expiration date stated in the front on the card and does not guarantee service at any of our participating stores.

Each card is designated for a single cardholder only. LBB does not permit the sharing of your card, discounts or online discount codes with any other person. If LLB reasonably believes that any of your card materials are being used in any of these ways, LBB reserves the right to cancel your membership rights immediately. If you believe someone has used any of you card materials without your authorization, please contact us at orangecountymommies@gmail.com.

In store purchases

You must present your card before you make a purchase at any participating business locations. Participating businesses have the right to deny a discount if you do not present your discount card before payment.. LBB is not liable or responsible for any customer/business disputes that may arise during a transaction that may or may not involve the membership card. All participating businesses have the right to refuse service and/or refuse to honor the card per their own customer service policy.

Online

In order to redeem discounts through our online participating businesses you must enter the discount code that is stated on the club page on the site.

4. Card/Membership Misuse

Any use of the card or the associated cardholder benefits and discounts in a manner that violates the rules or regulations of any participating business is prohibited by this agreement and is grounds for termination of your club membership. LBB reserves the right to cancel your membership rights immediately in the event of such a violation. LBB shall be the sole determiner in cases of suspected abuse, fraud, or breach of this agreement.

5. Participating Business Discount Offers

LBB makes all reasonable efforts to ensure the accuracy of the discounts offered and club membership benefits on the site.

Discount offers made available through the club may change from time to time. LBB reserves the right, in its sole discretion, to change the offers and/or participating businesses at any time. In addition, participating businesses may elect to change offers from time to time. LBB will make commercially reasonable efforts to make appropriate updates to the site to reflect any offer and/or participating business changes. If you become aware of a discontinued offer listed, please notify LBB by sending an e-mail to orangecountymommies@gmail.com.

LBB undertakes no obligation to provide a replacement or substitute offer for any offer discontinued.

LBB is not responsible for incorrect or incomplete information listed on the site regarding any participating businesses and/or the offered discounts. You may submit any corrections to orangecountymommies@gmail.com

LBB is not liable for any products or services provided by any participating businesses.

LBB does not guarantee that stated discounts offered to club members by the participating businesses are exclusive to club members and or the site.

 LBB is not responsible for third parties' restrictions or changes to their offers not communicated to LBB. LBB is not responsible if a participating business changes its discount due to new ownership or acquisition

 
6.  Expiration and Cancellation

Club Membership must be renewed every 6 months. If a member is in good standing and has not violated any set terms of membership, she may reapply for the next term of membership.  If any member decides not to renew their membership they will no longer have access to a club and/or the club and cardholder benefits.

7. Refunds

The club fee is non refundable. Interested parties are encouraged to review the discounts offered and this agreement prior to enrolling in the club.

6. Lost Cards

If your membership card is lost or stolen, LBB charges a $15 replacement fee. You can report lost cards by sending an e-mail to orangecountymommies@gmail.com

7. The Site (www.ocmommies.com)

The information on the site is provided "AS IS." LBB does not warrant, either expressly or by implication, the accuracy of any such materials or information provided on the site or their suitability for any particular purpose, and expressly disclaims all warranties, including, but not limited to, warranties of merchantability or fitness for a particular purpose. Although the information provided to visitors on our site is obtained or compiled from sources we believe to be reliable, LBB cannot and does not guarantee the accuracy, validity, timeliness, completeness or reliability of any information or data made available to visitors or its suitability for any particular purpose.

Neither LBB nor any of its affiliates, members, sponsors, employees, agents or participating business providers are liable or shall have responsibility of any kind to any visitor or member for any loss or damage that said party incurs in the event of (i) any failure or interruption of this website; (ii) any act or omission of any third party involved in making this website or the data contained herein available to visitors; or (iii) any other cause relating to a visitor's access or use, or inability to access or use, any portion of this website or materials on this website. In no event will LBB, its affiliates, subsidiaries, members, officers or employees be liable to any visitor or member for any direct, special, indirect, consequential, or incidental damages or any other loss or damages of any kind even if LBB or any other party has been advised of the possibility thereof. Finally, under no circumstances will LBB be liable to any member for a sum which exceeds the membership fees, if any, paid by said member for club membership.

8. E-mail Policy and Communication Preferences

LBB reserves the right to e-mail you with information essential to your participation in our program (for example, information changes to participating businesses and or discounts offered, card shipment information and card expiration/renewal). You will have the option to opt-out of e-mails of this nature by emailing orangecountymommies@gmail.com

10. Release of Liability

By participating in the discount club and/or using the card, members release LBB and its suppliers and agents from any and all liability for any loss, harm, damages, cost or expense, including, without limitation, property damages, personal injury and/or death, arising out of participation in the program and the use of or participation in any program discounts. LBB makes no warranty in any respect as to any merchandise or representation as to service available from participating businesses within the program.
